再審無罪間違ったら、冤罪防止のため警察の捜査を改革せよ。

 2020年度の愛知県弁護士会の刑事弁護委員に選任された。もちろん、刑事弁護委員になったこと自体はすごいことではないのだが、刑事弁護委員会がとりわけ国選について相当性を高めていく活動の一助となり得るような活動をなされることを期待したい。

 コロナ禍の騒ぎで大津地裁での西山美香看護助手の冤罪につき無罪判決が言い渡された。殺人事件とされたが、事故であり事件性自体が否定されたというのである。こうしたことを踏まえると、事件と思われる事象が発生したら、未だ誰でも良いから犯人をあげろという運用が警察にあることをうかがわせるのである。

 本日、朝日新聞「私の視点」に指導教官・指宿信教授の「裁判謝ったら独立調査を」が掲載された。

 しかし大津地裁の大西直樹判事は厳しく批判されるべきである。説諭であろうことか、無罪を訴えていた弁護士も批判したのである。誤判をしたのは大津地裁に他ならないであろう。

 そして大津地裁判事の説諭なるものは全く的外れである。

 誤判の原因は、第一、警察官の犯人権的取調べ、第二、検察官の有罪にしたいという方向性での思考停止的官僚主義、第三、判事と検事の癒着である。

 指宿論考は取調べの可視化及び証拠開示の充実を訴える論旨といえる。

 これは教授自体が昔から訴えてきたことに他ならないが実に正論である。

 まずは警察の捜査手法の改革なくして誤判防止なしである。

 私は指宿視点に全面的に賛同するとともに、臨床を10年行った経験をもとに補足意見を述べておきたい。

 第一に取調べへの弁護士の立ち合いが認められないことの不合理性は際立っている。そもそも検事と被疑者・被告人は当事者主義構造の下対等であり、弁護人を同席させて援助を受けることは当たり前となっている。のみならず近時、取調べに近い意味合いを持つ保護命令の審問、家庭裁判所調査官の非監護者調査などには当たり前のように弁護士の立ち合いがあり、前提誤認、議論にわたる質問、論争を挑むもの、事実誤認、カウンセラー証言になっているなど数々の異議を述べており適正化を図ってきた自負がある。そしてそれは決定に少なからずとも影響を及ぼしたものと自負している。

 そうであるとすれば、刑事に対する取調べの立ち合い、検事に対する取調べの立ち合いを認めれば、人権を擁護のうえ事実認定の適正化も図れる。

 現在G7を構成する、日本、アメリカ、イギリス、フランス、ドイツ、イタリア、カナダで取調べに立ち合いが認められないのは、日本とカナダだけである。

しかしカナダも最高裁まで持ち込まれた末のことであり、今後の変更が期待できるうえ、韓国や台湾での立会の当然視が日本の刑事司法が「中世」と論評されることは妥当である。

また、韓国ではマジックミラーから録音もされている。また、取調べに検事が関与する度合いが高いので、違法なことが引き起こされにくい。

指宿教授はすべての証拠の全面事前開示を認めるべきとするが、ディスカバリーの発想に根差しているといえよう。それだけに公判前整理手続の証拠開示は限定的なゲーム理論を導入したものであり、ゲーム理論で司法取引も現実的でない日本で有罪、無罪を迫るのは酷である。

私は、少なくとも検察官に無罪につながり得る証拠を発見した場合は、その証拠を弁護人に連絡し開示しなければならない、というブレイディ―バイオレーションという連邦最高裁判決を進めていくべきではないかと考える。

このような基準があれば、無罪につながる証拠がないのか弁護人からの問い合わせも可能になる契機が生まれるし、検察も改めて公益の代表者としての役割を自覚するだろう。

そのうえで、「航空事故調査委員会」のように独立した裁判ミスについての検証が必要である。医療でもミスについては、独立委員会の配置が進んでいる。しかし、日本では、裁判官は魔法使いのように、魔法の影に隠れ調査にも応じない。また検察官も同様であるのであって、独立調査委員会によって特に高等裁判所で「有罪病」や「有罪の追認率」が高い判事の再任拒否や簡易裁判所などへの異動を奨励するのが妥当である。

裁判員裁判を担当し、目の前での被告人の証拠はすべて無視され、シナリオのある学芸会のように、「犯行直後の警察官に対する供述は記憶も新鮮で信用できる」という認定に危機感を抱いている。つまり初動で警察の指図を受けて動機を供述させられてしまったらその後の裁判では何をやっても無駄という点もある。

少なくとも刑事裁判のうち裁判員裁判では伝聞証拠禁止の原則をもっと徹底するようにすべきではないか。

独立委員会の調査は、いわゆる密室、密閉、密会の「三密」で行われるから隠蔽され調査が必要というのである。しかし、そもそも韓国では取調べスペースは弁護人がアクセス可能であり、録音録画もされているし、不当な圧力をかけることもできない。

ただ、独立調査委員会は弁護士でいうところの綱紀委員会等が存在しないのであるから至極全うなものと思われる。

結論においては、①取調べに弁護人を同席させない限り完全黙秘運動、②完全黙秘を達成するのに必要な国選の弁護士の配置・増員、③裁判所専属の国選弁護士事務所の開設、④マジックミラーで弁護人が取調べ状況を監視し、かつ、録音録画を強制、任意にかかわらずすべて行うこと、⑤テレビ電話システムにより、接見交通の秘密が侵されても電話交通権を拡充させ防御権を拡大させること、まず捜査の段階でこれだけが重要であると思われる。

また、黙秘権や弁護人選任権の告知をしない場合は違法収集証拠として証拠排除相当性ありとする実務を確立させることと思われる。フランスでは、弁護人立ち合いか、呼び出したうえでなければ取調べができないととされる。

 そして、私が強く求めるのは被疑者保釈制度とバンクコート(保釈法廷)の新設である。被疑者段階での身柄拘束が長すぎることが虚偽自白の温床になったことは間違いがないし、誰とも話せないし外出もできない苦難から警察に迎合的な心理に陥るのは拘束者によくみられる心理傾向である。

 日本は共産主義体制でもなければ、人権が保障される国のようだった。しかし、人々は人身の自由や住居の不可侵などに鈍感になっていないか。

 自分が22日(逮捕期間も含む。)拘束され、わずかに嫌疑をずらされたら合計42日の身柄拘束に耐えられるだろうか。

 私たちは権力の性質について厳しい問いを発することでその政治的意味を損なうことなく、社会の人種的緊張、性別、権力関係、トラウマなど論争的主題に取り組むべきである。私が驚くのは、多くの人は指宿教授の意見に賛成であるが、具体的なアクションなくただ現在に寛容であることに皮肉を感じる。リベラルと呼ばれる人もまた被疑者の人権には鈍感である。

 COVID-19が発生し人権は冬の時代を迎えるかもしれない。ある弁護士は今だから述べる。「正義は方程式である。正義は、法とその時代精神(ツァイトガイスト)を掛け合わせたものでなければ法律自体成り立たない」

 冤罪といってももう彼女が失った12年の歳月は帰ってこない。裁判所が服役中の再審開始決定に消極的であることは手厳しく非難されるべきである。西山美香さんにかける言葉があるとすれば、警察、検察と判事の愚行に本当に苦しめられたといえましょう。法曹の一端としてお詫びしたい。そしてこう改めて述べたい。「被告人は無罪。上訴は不可能」。

 He was appointed as a member of the criminal defense committee of the Aichi Prefecture Bar Association for the year 2020. Of course, becoming a criminal defense commissioner is not a great thing in itself, but I hope that the Criminal Defense Commission will do something that will help the Commission to increase its relevance, especially in court elections.

 In the commotion of the corona peril, the Otsu District Court acquitted Mika Nishiyama, a nursing assistant, of false accusations. It was ruled a murder case, but it was an accident and the incidentality itself was denied. This suggests that the police are still in the process of asking anyone who wants to take the blame for a suspected incident.

 Today, the Asahi Shimbun's "My Point of View" published an article entitled "If you apologize for the trial, an independent investigation will be required" by his advisor, Professor Makoto Ibusuki.

 However, Judge Naoki Onishi of the Otsu District Court should be severely criticized. Whether it was an admonition or not, the lawyer who had pleaded not guilty also criticized it. It would have been none other than the Otsu District Court that made the wrong decision.

 And the Otsu District Court judge's admonition is completely off the mark.

 The causes of the misjudgment are, first, the criminal rights interrogation of police officers, second, the thoughtless bureaucracy of prosecutors in the direction of wanting to convict, and third, the collusion between judges and prosecutors.

 It can be said that the Ibusuki Review appeals for the visualization of interrogations and the enhancement of the disclosure of evidence.

 This is nothing less than what the professor himself has been calling for for a long time, and it is a very good argument.

 First of all, there is no way to prevent misjudgments without reforming the police's investigative methods.

 I fully agree with the Ibusuki's point of view, and would like to add a supplementary opinion based on my 10 years of clinical experience.

 First, the unreasonableness of not having counsel present at the interrogation is conspicuous. In the first place, the prosecutor and the suspect/accused are equal under a party-oriented structure, and it has become a matter of course to have a defense attorney present to receive assistance. Not only that, but in recent years, the presence of attorneys has become a common occurrence in the hearings of protection orders that have a similar meaning to interrogations, and in non-custodial investigations by family court investigators, which has resulted in a number of objections such as misrepresentations, disputed questions, disputes, misrepresentations of facts, and counselor testimony. And I'm proud to say that it had at least a small influence on the decision.

 If this is the case, allowing the presence of detectives and prosecutors at interrogations will help protect human rights and ensure that the facts are properly determined.

 Only Japan, the US, UK, France, Germany, Italy and Canada, which currently make up the G7, are not allowed to be present at interrogations.

However, Canada has also been taken to the Supreme Court, so we can expect changes in the future, and it is reasonable to argue that Japan's criminal justice has been described as "medieval" because it is taken for granted in South Korea and Taiwan.

It has also been recorded by Magic Mirror in Korea. Also, because of the high degree of involvement of the prosecutor in the interrogation, illegal things are less likely to be caused.

Professor Ibusuki's call for full disclosure of all evidence in advance is rooted in the idea of discovery. Therefore, the disclosure of evidence in the pre-trial liquidation proceedings is a limited game theory, and it is terrible to press for guilt or innocence in Japan, where there is no realistic plea bargaining based on game theory.

I think we should at least move forward with the federal Supreme Court's Brady-Violation ruling that if a prosecutor discovers evidence that could lead to an acquittal, that evidence must be contacted and disclosed to defense counsel.

Such a standard would create an opportunity for defense lawyers to inquire whether there is any evidence that would lead to an acquittal, and prosecutors would once again be aware of their role as representatives of the public interest.

On top of that, there should be an independent review of judicial errors, such as the "Commission to Investigate Air Accidents". Even in health care, an independent commission has been put in place for mistakes. In Japan, however, judges are like wizards, hiding in the shadows of magic and not responding to investigations. The same is true of prosecutors, and it would be appropriate for an independent commission of inquiry to encourage judges with "guilty diseases" or high conviction rates, especially in the high courts, to refuse reappointment or transfer to summary courts.

He is in charge of a trial by a judge and is concerned about the finding that all the evidence of the accused in front of him is disregarded and that, like a schoolyard with a scenario, "his statements to the police officer immediately after the crime are fresh and credible in his memory. In other words, there is no point in doing anything in a subsequent trial if you are instructed by the police to give a statement of motive in your first move.

The principle of the prohibition of hearsay evidence should be more thoroughly enforced, at least in criminal trials, in jury trials.

They say the independent commission's investigation is covered up and needs to be investigated because it will be conducted in the so-called "three secrets" - behind closed doors, under seal and in closed meetings. However, in the first place, the interrogation space in South Korea is accessible to defense attorneys, recorded and recorded, and no undue pressure can be applied.

However, since there is no such thing as a "disciplinary committee" as lawyers call it, the independent commission of inquiry seems to be the best way to go.

In conclusion, the following are important points: (1) a motion for complete silence as long as defense counsel is not present during interrogations; (2) the assignment and increase of court-appointed attorneys necessary to achieve complete silence; (3) the opening of a court-appointed attorney's office exclusively for the court; (4) the use of a magic mirror to monitor the status of interrogations by defense counsel and compulsory recording of all recordings, regardless of whether they are made at will; and (5) the use of a videophone system to expand the right of telephone traffic and the right of defense, even if the secrecy of face-to-face traffic is violated.

In addition, it is expected to establish a practice that, in the absence of a notice of the right to remain silent or the right to appoint counsel, evidence is excluded as illegally collected evidence. In France, an interrogation is only possible in the presence or summoning of a defense attorney.

 And what I strongly urge is a new bail system for suspects and a new bank court (bail court). There is no doubt that the fact that the detention of the suspect for too long became a hotbed of false confessions, and it is a common psychological tendency for detainees to become pandering to the police because of the hardship of not being able to talk to anyone and not being able to go out.

 Japan seemed to be a country where human rights were guaranteed, if not a communist system. But have people become desensitized to things like personal freedom and the inviolability of housing?

 I found myself on the 22nd (including the period of my arrest). Would he be able to endure a total of 42 days in custody if he was detained and the charges were slightly displaced?

 We should address controversial subjects such as racial tensions in society, gender, power relations, and trauma without undermining their political meaning by asking tough questions about the nature of power. What amazes me is the irony that so many people agree with Professor Shibuki's opinion but are just tolerant of the present without concrete action. So-called liberals are also insensitive to the human rights of their subjects.

 COVID-19 outbreak and human rights may be in for a winter. One lawyer states now and then. Justice is an equation. Justice cannot be law itself unless it is multiplied by the law and its zeitgeist (Zeitgeist).

 Even though she was wrongly convicted, the 12 years that she lost are no longer coming back to her. The court's reluctance to make a decision to commence a retrial while serving a prison sentence should be severely condemned. If there is a word for Mika Nishiyama, it would be to say that she was truly tormented by the folly of the police, prosecutors and judges. As a member of the legal profession, I would like to apologize. And I would like to reiterate this. The accused is not guilty. No appeal is possible".
